The Supreme Court overturns the bump stock ban in Garland v. Cargill on June 14, 2024. The decision was 6-3 along party lines and Justice Clarence Thomas wrote the majority opinion with Justice Sonia Sotomayor writing the dissenting opinion. The ruling overturned a Trump era ban on bump stocks after one was used in the 2017 Las Vegas shooting.

Background – Las Vegas Shooting

A gunman used rifles with bump stocks to shoot patrons at a music festival in Las Vegas in 2017. He killed 60 people and injured over 500 people. The ATF responded the next year by classifying bump stocks as illegal machine guns. This required the owners of those devices to destroy them or turn them in. This affected many law abiding gun owners who found themselves in danger of violating the law after the change.

ATF Overreach

This ruling is another example of the courts taking on ATF overreach like they did with the pistol brace ban. The ATF likes to change the rules to retroactively make millions of legal gun owners criminals if they don’t destroy or turn in property that they legally purchased. Fortunately, the courts have been able to rule sensibly in favor of the Second Amendment.
